Discovery Rules

Criminal or civil litigation is the last resort for seeking justice from the system. Given the large number of litigation suits filed in democratic countries as the United States, there is a need to seek recompense in justice outside the legal system or before parties concerned agree to bring the issue to a court of law. These measures however need to be institutionalized so that both parties are satisfied with the processes and are encouraged to resolve the matter outside the court of law.The mechanism of discovery rules is one such instrument which has provided for pre-trial phase in a law suit. The discovery procedure allows the parties in a law suit to request for evidence including documents from the other parties. The law provides for making such requests which could be for production as well as depositions. If required sub poenas can be issued for production of evidence. The discovery rules if used purposefully can lead to minimizing litigations as well as provide justice to l itigants.The aim of the prosecution is to collect sufficient evidence to establish veracity of the case and to ensure justice. However frequently the prosecution acts as an instrument to prove guilt of the accused. This mistaken notion results in subverting the very process that is required to be undertaken under the discovery rules. To avoid this anomaly it is essential that the prosecution discloses all evidence to the accused in a criminal case prior to the trial.Having so displayed information in all respects, be it exculpatory or inculpatory by the prosecution, the defendant will be able to establish culpability of the offence and in turn decide either to challenge the case or to disclose as much evidence as possible for the prosecution to assess if the case is to be pursued or will achieve the ends of justice. The defendant is granted very justifiably protection under the Fifth Amendment, a privilege of attorney-client relationship as well as against self recrimination because of which he should not be required to disclose evidence to the prosecution.This ensures that practical problems of implementing discovery rules are overcome. Prosecution can misuse discovery rules to extract maximum evidence regarding the case to strengthen arguments rather than seeking ends of justice. As Stracher (1998) has indicated the best legal minds are involved in manipulation of evidence rather than seeking ends of justice. Thus it would be appropriate for the defendant is able to exercise privileges granted in the present socio-legal environment.

Teenagers – not as bad as they are portrayed?

Britain altering her ways, has successfully managed to keep up with the ever changing world. However the youth of our day, seem the only change society somewhat fails to keep pace with. Are we leading our teenagers forlorn? Teenagers are categorised under offenders and criminals and not to mention are covered by an umbrella of stereotypical views of which if its coverage of teenage Britain fails to cease would be a slow and gradual obliteration of Britain’s future. If society takes a step back and realises the sought of pressure left upon the shoulders of our future leaders, doctors , engineers etcetera we would come to the realisation that the strain put on them is a strain put on the nation’s future. Furthermore, as the well-being of the nation hangs in the balance it seems as if eyes are staring purposefully watch it lose its balance with the likes of the media broadcasting nothing but the negatives, painting a villainous image of which the public do nothing but believe. Although there are some teenagers who follow the wrong path, statistics show 10 percent of anti-social behaviour were committed by them and the increase of knife crime amongst teenagers increased by 2 percent over the past year however it seems statistics like this also fail to mention the other percentage of teenagers who actually do something valuable for the society such us charity work, and those whom constantly thrive in the aspiration of making the nation a good one to live in, until then the current government has to work on making this nation a bearable one to live in. The constant pressure from the media towards the teenage generation has yet to show the many good works of the youths. ‘’Back in my day†¦Ã¢â‚¬â„¢Ã¢â‚¬â„¢ seems to be the reoccurring statement by the nostalgic few, the few, whom believe that without the morals and discipline of the old age teenagers today show no respect for society today, however, Do they know how it is to work in a teenagers shoes. Above all, teenagers still get along with life amongst all the turmoil: postcode wars, gang warfare and peer pressure. Being at a vulnerable stage in life, youths feel pressured into becoming the image everyone expects, seen in the small town of Lancashire where a normal boy named Tom, was bullied to the extent he committed suicide, this in itself is not accepted in society. ‘’Now I will not get to see my son lead a normal life’’ said Mrs Smith tearfully. Would the outcome be different if he spoke to someone? 2011 witnessed the London riots, often described as ‘’mindless act of violence ‘’ saw parts of London set ablaze teenagers seen as the apparent cause, could this have been prevented? Or was this just a way to gain attention from the society as they have been put on the lower end of it, always put at the receiving end of pessimistic views. Although this would be seen by some to be destructive, inconsiderate and uncalled-for , this might be what teenagers think would actually make sure their voices are heard and also make sure they have an actual say on what decisions are made about them. The life of teenagers would continue to remain a mystery to some, as times change people also change, if things do not change for the better the life of a 21st century teenager would continue to be hard.

Does Democracy Ensure Freedom Essay Does democracy ensure freedom? I believe democracy can ensure freedom, but not always, thus my answer is maybe. For democracy is a form of government that rely on a system of law in which individuals are treated equally while having fair access to the legislative process through electing official who will act in their constituent’s interest and voice their concern. Through proper protection with legislation, individuals freedom can be ensured. Yet the nature of democracy favour majority thus it is possible for politician to cater to the mass to secure vote and have access to the seats of power. Democracy is unable to act if the votes are tied, such flaw can leads to politician abuse their power tilting the result either way to further his own goal. If elected official no longer voice the population yet game the system by continue to appease the majority, minority right and freedom can not be ensured. Government ultimately objective is to govern the people for the betterment of people, thus democracy reflects the need for it is form of government allowing peoples voice being heard through the elected officials. Each voters vote count and the majority trumps. Elected official then go on legislate laws that regulation that resolves the populations concern. Such fair access to the legislative process and equality before law ensure the population to be protected, the law are made by them and for them, protecting their freedom and rights. But democracy also follow majorities rule. It is possible for 49% of population to lose out simply because of the 2% difference. Yet if rights are cemented fully protected via charters, even minorities can escape such tyranny. Unfortunately, elected officials can not always complete reflect the desire of the entire population. They are at best incomplete projection if not catering to special interest or simply the mass for the system favours the majorities, and once tied vote occurs. The decision will lie solely on those in power. For few individuals to be able make decision that influence a nation, such power can be attractive if not lucrative, for there is motive and it is not hard to imagine such corruption taking place. Once a politician is no longer serveing the voter but himself, without proper check and balance for the government to self correct such mistake. It is to picture minorities right and freedom being sacrificed for the corrupted official to stay in power. The key all hinges on the soundness of said countrys legal system, if a government official have the power to alter laws, taking away rights and freedom as he pleases. The freedom can not be ensured. Yet, with a proper procedural fair legislative system, the inbuilt checks and balance will stop said corrupted official overstepping his position. The electoral system will kick in which official will be replaced if they do not deliver what is expected off them. With a solid charter of rights, even minoritys innate rights and freedom can be protected against majorities for the inalienable rights protect each of us and allow us to maintain the dignity we all possess. Freedom is the concept that verges upon the condition in which individual live their life accord to their free will. For they make their own choices without facing disabling condition nor the pressure of simply fulfilling the basic necessities of life. We choose how we present ourselves to the world and how we communicate our idea and thoughts. We decide on how to live our life, from our goal to our means of achieving said goals. Yet these seemly innate right are in fact fragile and vulnerable. The nature of government impose rules and regulation with our daily life. Our freedom is merely conditional, for we can only exercise our right and freedom to a certain extent. As matter of fact, our right and freedom can be taken away by the same law that protect our rights and freedom. But that is the truth of reality, freedom without bound is impossible. The physicality of reality impose restriction, scarcity of recourse and mortality of men. Civilization dictates rules from punishment of crimes to shame and guilt through morality. Thus government, a form of rule, can not truly ensure freedom for its conditional and with limits. Men has long realize such limitation, yet we still yearns for such notion for we are driven by our free will and we seek create such system for we are protected from not just each others but ourselves own infringement of rights and freedom. Democracy is still our best attempt at this unrealistic dream, the approach is simple, for a system of law made by people for people. We strive to effectively govern ourselves and keep our right and freedom. It is understandable to treat the question â€Å"does democracy ensures freedom ? † in an bifurcate manner. It is easy to state the fact that democracy is simply mob rules thus two wolves can vote having the sheep for dinner against the one lone sheeps objection. Yet it seems silly to categorize a whole countrys population into a predator/prey relationship, not to mention having a sound legal system in which inalienable rights of human beings are guaranteed can indeed prevent the two wolves ganging up on the sheep, minorities can still be sufficiently protected by law if the charter of rights allows. Further more, freedom can only be secure via proper system of law that protect human right and freedom, types of government should not be the deciding matter for ensuring freedom. As the above paragraphs have shown, democracy either ensure nor deny freedom, while there is no true freedom under any form of government for by definition of government, restriction and restraints are naturely imposed upon individuals. I still consider limited conditional freedom preferable to none for my inalienable right are protected even against the tyranny of majorities for this rights are inalienable. While democracy can allow favour toward the majorities and official in position of power, with proper checks and power established within the government, such issue can be self corrected. But without the legal safenet, minorities can easily been swapped up by politicians agenda and sacrificed to the tyranny of majorities. As a partying thought, if no form of government can achieve true freedom, what is the future of democracy with our society?

Gender stereotypes and perceptions in society Stereotype refers to the cognition aspect of feeling towards a given group of people. It is the picture that most people engulf in their minds about other people. However the picture painted by people with regard to other people is not necessarily a true depiction of the reality. Stereotypes hold the fixed view that people of a certain community or group exhibit specific character traits, which influence their behavior in general. Stereotypes as regards gender, refer to certain traits presumably adhered to males and females in the society, that define and distinguish these genders. According to Mynhardt, the two genders (males and females) portray traits which are both negative and positive. Gender stereotypes have far reaching consequences and cannot be taken only on face value. The issue of gender stereotyping is deeply entrenched in our society, that it has gone to an extent of defining the status of people and the positions people hold depending on gender. For instance, the chara cter traits associated with women are regarded to be unfit for positions of a higher stature. This kind of attitude is not new even in the developed world. For instance at the height of campaigns in the United States, there were numerous debates on and off the media on whether America was ready for a woman president. This certainly illustrates the biased perceptions that more often than not prevent women from reaching the positions at the highest level, simply because of the gender. There are certain aspects of everyday life that are traditionally attributed to males and females in the society. The manner in which the men and women carry themselves around is fundamental to the definition and distinction of gender in general. There are acts both of omission and commission that are associated with each gender. However as days go by, the society undergoes transformation and so do the traditions and cultures that shape and influence the society as whole. In the family set up for example, the different roles are distributed depending on gender. There are also perceptions relating to the behavior of people that distinguish what are expected and what is not expected from people of a given gender. For example sensitivity, dependence and expression of emotions are considered feminine in nature. The men on the other hand are expected to exhibit traits such are bravery, independence, assertiveness and none of those traits that are associated with the women. However these c ultures that build perceptions continue to fade with each passing day. As a result, there are many incidences of deviation from gender roles prescribed by society. The violation of these gender role stereotypes are accompanied by consequences largely due to the perceptions held by the society. Violation of gender role stereotypes The reception to those who deviate from the normal traits associated to their respective genders is no bed of Roses. The manner in which the violators are treated is no doubt unfavorable in most aspects. The reception however differs depending on the environmental set up and more so whether the person is male or female. In the event that males and females deviate from the roles prescribed by society as regards their gender, the males are more likely to receive a hostile reception. The women on the other hand, will most likely receive little attention. This all has to do with the issue of status in social aspects. There is the general perception that the masculine traits occupy a higher stature than feminine traits. Looking at the issue of sexual orientation, for woman behaving in a masculine way, it does not raise eyebrows, however if a man were to behave like a woman, this will no doubt be a big deal. The man will most certainly be referred to as a homosexual. In the work place howe ver it is the women on the receiving end in the event of deviation. A woman who is charge of a given organization will most likely receive an unfavorable evaluation compared to a man, if she acts in a manner that violates the perceived traits of women and takes the route of a leader which is authority and commanding results in the work place. Social perception of males and females who violate gender role stereotypes There are numerous perceptions as regards the question of gender role violation. However according to Sirin, Selcuk R., McCreary, Donald R., Mahalik, and James R. authors of the journal of menà ¢Ã¢â€š ¬Ã¢â€ž ¢s studies, the notable social perceptions revolve around social status, sexual orientation and the dissimilarity of value. The perceptions exhibited are most of the time firmly in the grip of culture and are subsequently fuelled and driven by the traditions of the people in the society. The issue of culture and tradition set aside, expectations also play a significant role. There is a general expectation from both genders on the manner in which the other gender should behave. One thing cut across the divide and this is the fact that women anchor the expectation that men should display masculinity. The same is anticipated by men who are of the view that women should be feminine. Any sort of trait that does not meet the above expectations, it is considered a violation of gender r ole stereotype, which is accompanied by negative perceptions. For a long time, gender has maintained a significant influence in the manner in which people conduct themselves in the society. The issue of status as regards the males and the females is what dictates the way in which males and females are regarded in the event that they violate the prescribed code of conduct that is attributed to their respective genders. According to Feinman, in relation to the social status model, he writes that the men have a status that is superior to that of women. Going by the model on social status, then men will more often than not face an unfavorable evaluation, should they violate the prescribed code of conduct for their gender this is because, the violation means that they lose class when they deviate from a status of a higher nature to a status that is low. For women whenever they deviate from perceived traits are assumed to be transforming from a lower status to a higher status. Hence the social perception with regard to the violation of gender role st ereotypes is positive to a large extent. This is no doubt something that is rife in the society, as a matter of common societal law, to whom much is given a lot, is expected. For instance woman who dresses and behaves like a man will most likely go unnoticed or may even command respect from people around. This however is not the case in men. A man who dresses and behaves like a woman will most likely be despised. To a large extent this is all attributed to the distinction of the social status between the men and women. According to Feinman the male role is more valuable than that of the female. He further writes that it is acceptable for women to adopt the roles of men rather than men take up the roles of women. Violation of the gender role stereotype has consequences for both the males and the females. However there is no denying the fact that, the reception received by the males as regards their transgressions is more hostile compared to the women. If anything the women may in some instances be perceived in a positive way. The issue of desire is the other frontier for the perceptions of gender stereotypes. According to Sadalla, Kenrick, and Vershure (1987), men who show traits of not being dominant are deemed to be undesirable. This perception is however not just directly related only to the dominance aspects, but to all traits in general. There is the general perception that, men who exhibit traits that are a deviation from the known male traits are not desirable especially from the womenà ¢Ã¢â€š ¬Ã¢â€ž ¢s point of view. The other perception that is anchored in the minds of the people is the issue of respect in the society. This directly affects men in a negative way and does not have any negative impact on women who violate the gender role stereotype. It is perceived that, men who deviate from the normal societal norms loose respect from their peers and even the society in general. For women on the contrary, the perception is that, they will command respect and admiration from their peers in the event that they deviate from the prescribed societal code for the female gender. The perceptions on women who violate the gender role stereotype is not at all constant, it keeps changing depending on the environmental set up. For the men however, the perceptions when they deviate from the gender role stereotype are the same and fixed, at no time will the transgression committed by men receive a positive evaluation. Conclusion The gender stereotypes and overall stereotyping continues to not only shape but also influence the behavior of all people regardless of the environmental setup. As illustrated above, the burden to conform to societal norms associated with gender is more often than not rested on men to shoulder it. This is not to say that women do shoulder any negative perceptions, the women too have their fair share of tribulations that arise from the gender role stereotype. Even so, regardless of the environmental set up, the perception is that the men will always get a hostile reception when they violate the gender role stereotypes compared to women.

Jacqueline Kennedy is probably best known for her style, love of art and history, and family values. She never looked to be First Lady but took on the role she needed to. Sometimes people seemed more interested in her than the president himself. Jackie was more appealing than previous First Ladies. She was original and dignified. She helped increase the popularity of her husband. She did what was called from her while still maintaining who she was. She was an inspiration to women everywhere. She will always be remembered for being a powerful woman. She knew she wasn`t the classic First Lady material. â€Å"The trouble with me is that I`m an outsider. And that`s a very hard thing to be in American life† (Perry 53). She knew who she was and she went with it. She didn`t try and change for what people wanted her to be. Many people try to change to the image people want them to be but she didn`t Family was the most important thing to Jackie. â€Å"If you bungle raising your children, I don’t think whatever else you do well matters very much† (Karen 37). She set a standard for mothers everywhere. â€Å"I’ll be a wife and mother first, then First Lady† (Klein 98). All that mattered to her was to be a family. She understood, no matter how important a position, family came first and always would. â€Å"The children have been a wonderful gift to me, and I’m thankful to have once again seen our world through their eyes. They restore my faith in the family’s future† (Anderson, 176). Her children were her world; everything she did was for them. She tried her best to be the perfect mother. She also valued her marriage. â€Å"Jacqueline wore a choker of pearls and a diamond bracelet that was a gift from the groom† (Bowles 63). They are who they are and no one will ever be able to change that. They are above the trivial ways of trying to fit in to get people to like them. She had all she wanted, her family and the rest didn’t matter. No one would ever be able to shape her into what they want. She wasn’t out spoken but she didn’t let people use her. Isn’t that what makes heroism? She was someone who would never do something just because society told her. Isn’t that which make progress possible too? There are few ways progress can only be made by those who are willing to be different and not conform to society. Maybe that is what everyone liked about her, how she couldn’t be manipulated. She was always aware what was going on but it never caused her to change.

Tess of the d’Urbervilles and Perfume: The Story of a Murderer Essay

Control is the social construction constituting exercising authority over other beings. It can take many forms, the most prominent of which between Tess of the d’Urbervilles and Perfume: The Story of a Murderer being physical, psychological, capitalist and patriarchal. Both novels are of the Bildungsroman genre, however whilst Jean-Baptiste  Grenouille has a predatory and psychotic personality, this is something to which Tess  Durbeyfield  is subject without reciprocity until the end of the novel, and it is ultimately this  hamartia  which leads to her oppression. Physical Under the historical influence of Darwin’s natural selection, Hardy attempts to highlight the physical control that Alec has over Tess through an animalistic comparison. In a reference to the rape of Lucrece, and thus to Tess’ rape, he states ‘the serpent hisses where the sweet bird sings’. This imagery highlights the sly, predatory tendancies of Alec, and diametrically opposes them to Tess’ delicate predispositions. Later, Hardy implies  that she  is raped. ‘Feminine tissue, sensitive as gossamer’ displays Alec’s unconscious urges to control such a virgo intacta. The sibilance in this phrase contributes to Alec's presentation as a predator she is also described as ‘blank as snow’, a tabula rasa, a form of innocence Alec physically destroys. These factors, along with the traditional norms of wedding days, culminate to create a grotesque parody of a wedding night. The  moon’s later description as ‘tarnished’ is symbolic of how Tess’ has been physically abused  by Alec, although it also exposes a disrupted parallel between the moon’s 28–day cycle, and Tess’ menstrual cycle due to the development and birth of Sorrow. Implementation of K-12 Essay

Why add two years? This is the question everybody is asking. â€Å"We need to add two years to our basic education. Those who can afford pay up to fourteen years of schooling before university. Thus, their children are getting into the best universities and the best job after graduation. I want at least 12 years for our public school children to give them an even chance at succeeding. †President Benigno S. Aquino† These are the words that really made a great impact to me. Since, at first I was one of the many individual who also questioned this change of curriculum. But as I have watched the AVP that question was answered by these words of our president. I could say K+12 Curriculum is a good program of the department of education since it is presented that it will decongest and enhance the basic education curriculum. It will also give better quality education. It was also mentioned in the AVP the benefits of this curriculum such as; The Enhanced K+12 Basic Education Program will be instrumental in achieving the nation’s vision of high school graduates. The benefits of the K+12 proposals far outweigh the additional costs that will be incurred by both government and families. An enhanced curriculum will decongest academic workload. Graduates will possess competencies and skills relevant to the job market. Graduates will be prepared for higher education. Graduates could now be recognized abroad. The economy will experience accelerated growth in the long run. The Philippine education system will be at par with international standards. A better educated society provides a sound foundation for long-term socio-economic development. Learning comes when you better understand the things that are taught to you. As an educator I could relate to this since I have seen that children can interact more if they know and they understand the words or language you’re using. Thus making the curriculum decongested can really help the pupils to better understand their lesson and acquire more learning. I am a grade I teacher in Masulog Elementary School, and as part of the K+12 Curriculum grade I teacher use the MTBMLE (Mother Tongue Based Multi-lingual Education) as learning area and used as medium of instruction in this way children can easily recognized things, express their thoughts and for me understand their lesson so maximum learning is acquired. It also helps in bridging or transition Filipino and English as language of instruction introduced in Grade 3. For me I would say that I agree with the viewpoint expressed in the AVP, K+12 Curriculum can really alleviate the standard of education. It will also give every learner an opportunity to receive quality education based on an enhanced and decongested curriculum that is internationally recognized and comparable. Though there are issues and concerns with this new curriculum like competencies demanded of teachers for effective implementation of K+12 especially in grades 11-12 (pre-service and In-service Education, preparedness of DepEd K+12 BEP implementers (teachers, school heads, supervisors), transition period in the MTBMLE progression program, MT proficiency of teachers in the MTBMLE program, preparation of learning materials, literary and informational texts in K+12 and more. But, if education could be the only best option to secure the future of our youth, all of us are here to support this option.

Even in the 1960s the jungle remained terra incognita, an unknown land with the power to hold the technology of mechanized warfare beyond its periphery. And with good reason, Munro though. Men just did not belong there. He was not pleased to be back. Elliot, never having been in a rainforest, was fascinated†¦ [skip to next page] Because Elliot had looked forward to his first experience of the equatorial African rain forest, he was surprised at how quickly he felt oppressed–and how soon he entertained thoughts of leaving again.Yet the tropical rain forests had spawned most new life forms, including man†¦. As he walked through the forest, Elliot found himself thinking of it as an enormous hot, dark womb, a place new species were nourished in unchanging conditions until they were ready to migrate out to the harsher and more variable temperate zones. –This passage has a couple competing ideas that illuminate the other tensions of Congo. Munro says that humans do n ot belong in the jungle and despite Elliot’s initial enthusiasm his later feeling of â€Å"oppression† puts him closer to Munro.But Elliot also thinks that the rain forest is where life comes from, including humans, a place free from the â€Å"technology of mechanized warfare† that destroys life without replacing it. So, if we read this together, humans owe a debt to the universal origin of life but are now cut off from it and feel it as a mysterious enemy. In a way, though, language lets us re-enter or re-connect with this origin of life through Amy and her connection to the world of gorillas and humans. Day 8 Chapter 4: But he know what Munro was saying.Inevitably, people who raised apes found at a certain point they could no longer keep them. With maturity the animals became too large, too powerful, too much their own species to be controllable. It was no longer possible to put them in diapers and pretend they were cute humanlike creatures. Their genes coded inevitable differences that ultimately became impossible to overlook. –This passage is interesting because it helps to explain some of the commentary elsewhere in the book about how humans are affecting the world.Like apes, human civilization has grown up and escaped from the control of nature: we are too large and too powerful for the jungle to resist our bulldozers and chainsaws. This passage also seems to imply that each species has a genetic nature that it cannot resist, so we will probably be helpless to stop ourselves from exhausting our natural resources unless it is also part of our nature to check ourselves. Day 9 Chapter 1:He also found it off that the information recorded by the video camera had to travel more than twenty thousand miles before returning to the display screen, only a few feet away. It was, he said later, the â€Å"world’s longest spinal cord,† and it produced an odd effect. Even at the speed of light, the transmission required a tenth of a second, and since there was a short processing time in the Houston computer, the images did not appear on the screen instantaneously, but arrived about a half a second late. –Even out of context this passage is an interesting commentary on our every day lives.Although we know that light and sounds travel at certain speeds we are used to feeling like we are immediately connected to our surroundings; however, the infinitesimal gap between our selves and our world becomes apparent through technology. This is ironic since, as in the passage quoted, technology gives us knowledge of the world we otherwise wouldn’t have. But the price of knowing more about the world is that we are also farther away from it. Discussion Director In Day 11 Chapter 2 Ross says, â€Å"People worship what they fear†¦ oping to control it.† How might this be a commentary on Congo? Congo creates a magical and mythical species of gorilla to terrorize the intrusive Westerners. Although an alternative explanation in the novel explains what is happening in the city of Zinj, Congo represents to us what we fear. However, what we are led to â€Å"worship† is not the violence of the gray gorillas but Amy’s language abilities. The possibility that animals can be equal to humans in mastering language is something we fear and make stories about in the hopes of controlling it.Day 13 Chapter 1: What does the team’s reaction to the discovery of diamonds say about the difference between humans and animals? Animals are usually thought to respond to training in a relatively mechanistic way, whereas humans are thought to possess free will. The recent defeat of the gray apes agrees with this: they could not resist the broadcast with their own will and had to obey it. However, even though the humans are in danger for their lives they pursue the blue diamonds as if they are worth more than life itself.How does Crichton’s selection of References make you f eel about the truth of the novel? The references show that there are real scientific observations and facts underpinning some of the technical aspects of the novel. On the other hand, it is clearly a novel of fiction that depends on some pretty fantastic departures from the real world for its effect and to make its points about human-animal communication. Ultimately it indicates that even scientific facts can be bent around a convincing narrative and put to the service of something that is not scientifically verifiable.

Fault In Romeo and Juliet Essay

In William Shakespeare’s play, Romeo and Juliet, one of the main characters, Juliet, commits suicide near the end of the play. Friar Lawrence is directly responsible for the death of Juliet in all ways. He makes not only one, but three mistakes that all lead to Juliet’s death. He gave a poison to Juliet, he trusted someone else with a letter of great significance to deliver to Romeo, and he fled when Juliet was in the most danger at the tomb. Had he not have made these three major terrible mistakes, Juliet might not have killed herself. Friar Lawrence made a major mistake that he could have avoided himself. He trusted Juliet, an unstable teenage girl, with a fake-death poison. This rash decision was a very poor choice on the friar’s behalf. Here, the friar shows his irresponsibility by saying, â€Å"If†¦ thou hast the strength of will to slay thyself†¦ take thou this vial†¦ no warmth, no breath shall testify thou livest;† (4.1.72, 93, 98) Fr iar Lawrence’s idea for Juliet is very risky and he should have known better than to try it. Because of what happens, everyone thinks Juliet is dead and shortly thereafter, she is buried alive. This quote shows the true meaning of responsibility, because when he says this, her life rests in his hands. Capulet is even foiled by the plan, because when he says her faking her death, he said, â€Å"Death lies on her like an untimely frost.† (4.5.28) The fake death has fooled Capulet, Juliet’s father, and the rest of the family. Had Friar Lawrence not have given Juliet the poison, she would have never been put in the position that she was in, which eventually leads to her death. Trusting Friar John to send the letter, and not even telling him that the letter was urgent, was Friar Lawrence’s next big mistake. The mistake of him sending someone else to do it was inexcusable; a matter as important as faking death should be dealt with personally. Had Friar Lawrence have personally delivered the letter, the plan might have gone smoothly. Friar John shows his incompetence in the fifth act when he says â€Å"I could not send it – here it is again -† (5.2.14). Showing Friar Lawrence’s poor decision making again, this quote perfectly shows how Friar Lawrence is responsible for Juliet’s death by choosing to send the letter instead of delivering it. At that, he should not have trusted someone as mediocre as Friar John. â€Å"The letter was not nice but full of charge, of dear import, and the neglecting it may do much danger.† (5.2.18-20) Friar Lawrence trusted a complete buffoon at the most crucial of times and the price was paid for the actions of both friars. Consequently, Juliet dies because Friar Lawrence did not think through that something might arise and a situation this urgent must be dealt with personally. Friar Lawrence could have easily avoided the situation. Cowardice, plain and simple, was also another reason why Friar Lawrence was responsible for Juliet’s death. He runs away when Juliet needs him the most, and in leaving her alone, she kills herself. In the tomb scene, Friar Lawrence attempt’s to help Juliet before running away. â€Å"(Friar Lawrence): Stay not to question, for the Watch is coming. Come go, good Juliet, I dare no longer stay. (Juliet): Go get thee hence, for I will not away.† Friar Lawrence puts himself before Juliet, and worries about getting caught by the watch. He leaves Juliet when she needs him most. Friar Lawrence shows here that he really does not care about Juliet, and that he is very self-centered. He leaves her to kill herself, even though it is entirely his fault that she is even in that situation. Had the friar not have left the tomb, then Juliet might not have had the opportunity to kill herself, as you can see she does in the following quote. â€Å"Yea, noise? Then I’ll be brief. O happy dagger, [taking Romeo’s dagger.] this is thy sheath; [stabs herself.]† (5.3.169) Juliet says these final words before killing herself. We see here what results directly from Friar Lawrence leaving the scene when he should have stayed. Had he stayed, he could have at least attempted to wrench the dagger from her hand, or comforted her until she let go of the knife. Instead of staying to help he chose to run away from the watchmen for his own safety, and because of this final, terrible choice, Juliet ends up dead. Friar Lawrence makes many bad choices throughout the play; choices that are inexcusable. When he made such terrible choices, he inevitably doomed Juliet to her death. His irresponsible choices, trusting Juliet with poison, giving the letter to Friar John, and running away at the tomb, were awful choices. He consistently shows that he is an awful decision maker, and he is entirely responsible for Juliet’s death. One could even say he is more responsible for the death than Juliet herself.

Motivational Leadership Essay

Effective leadership has a tremendous impact on the success of an organization. Darling & Heller (2011) infers that â€Å"with regard to individuals in leadership roles, their thoughts and feelings, fundamentally based on attitudes, thereby also control the levels of organizational success and every other aspect of an organizational leader’s arena of endeavor† (p. 9). Achieving optimal organizational performance is very much so dependent on the effectiveness of that organization’s leaders. Five topics interrelated to leadership effectiveness will be addressed in this paper. (1) Feedback works for leadership and tell why you think it could be beneficial. (2) Present an overview of the Contingency Theory of Leadership effectiveness to include Situational Leadership II. (3) Share some ways that you as a leader could lead your company in being socially responsible and creating an ethical organization. (4) Provide a brief analysis of empowerment; be certain to include the relationship between delegation and empowerment. (5) Discuss how leaders can foster teamwork within a group. All of these topics and/or concepts are essential aspects to achieving high levels of quality, roductivity and satisfaction within an organization. The concept of 360-degree Feedback is to formally evaluate an organization’s leaders through feedback from individuals that work closely with those leaders (e. g. subordinates, colleagues, direct supervisors, other superiors, suppliers and/or customers). According to Dubrin (2010), 360-degree Feedback is also referred to as multisource or multirater feedback, and is systematically derived from a full sampling of parties who directly interact with the leader (p. 110). One particular method for organizations to easure leadership effectiveness through the 360-degree Feedback concept is to set up a system utilizing the internet or the organization’s intranet. That system should be based on the attributes that organization deems to be the most significant and valuable. The 360-degree Feedback is of great benefit to leaders in providing them insight into the effectiveness of their behaviors and styles. The feedback mainly serves for developmental purposes (behaviors, attitudes, and styles), and not for the purposes of evaluating the leader’s performances. The 360-degree Feedback not only benefits the ndividual leaders, but it also is a vital component to the organization, as a whole. Organizations benefit from 360-degree feedback instrument in the following ways: (a) individual performance improvement, (b) impact on business goals, and (c) impact on organizational culture (Rehbine-Zentis, 2007, p. 160). The Contingency Theory of Leadership is the assumption that a leader’s ability to lead is contingently based on various situational factors, internally and externally. The following are various factors that could greatly influence a leader’s effectiveness within heir organization: the capabilities of the workforce, the culture within the organization, and the competiveness of market. Leaders who are have been highly effective within one organization, may not deliver that same effectiveness within a different organization. An important perspective on implementing contingency leadership is that the leader must be flexible enough to avoid adhering to old ideas that no longer fit the current circumstances or situation (Dubrin, 2010, p. 133). I can definitely see the validity of the theory in reference to my own experiences in previous leadership positions. It is absolutely about he ability to successfully and effectively adapt to different organizational environments. Like the Contingency Theory of Leadership, the Situational Leadership II style is a contingency leadership approach that is solely based on the theory that there is no one particular best style of leadership that fits all situations. This leadership style focuses mainly on the capabilities or behaviors of individuals and/or groups that one leads. Blanchard (1997) asserts, â€Å"Situational Leadership II advocates that the best leaders provide the amount and kind of direction and support which best fits the developmental evel of the employee† (p. 38). As a leader, I can encourage my organization to focus on ethical business practices and social responsibility, beyond profit pursuit, based upon our strategic organizational goals, mission and vision statements. I would initially ensure that the organization’s environment was a positive, engaging culture conducive to intellectual development. Individuals within an organization invest about one-third of their time at work, a pleasant work environment increases the chances that their life will be enriched (Dubrin, 2010, p. 181). There would be a significance placed on competing fairly and onestly, not causing harm to others (internally/externally), and communicating truthfully. I would ensure that my organization is offering goods and services that are valuable and essential to consumers. We would be consistent in providing quality employment to individuals which would benefit them in providing for their families, in the forms of, paying them salaries/wages, offering quality health insurance and/or child care services, matching retirement plan contributions, etc. We would also benefit society in maintaining ethical practices in our financial obligations through paying taxes which elps fund education, support government, build highways, as well as provide funds to enhance our local, state and national public safety/defense systems. According to Forsyth (1997), â€Å"genuine changes to business practices have to be made in order to protect the environment† (p. 272). I would ensure that, as an organization, we were utilizing the most up-to-date technology and economic solutions to reduce or alleviate any environmental issues that we faced. My organization would take every possible precaution to not generate unnecessary waste and pollution through the improper onsumption of resources, as well as from the possible emission of toxic air pollutants caused by our manufacturing processes. The concept of empowerment involves a power transfer from higher levels of employees to lower levels of employees within an organization (Khalid & Sarwar, 2011). Leaders that utilize positive empowering practices with their employees are more likely to increase their organization’s productivity. When employees are given the opportunity to share in the responsibilities of their leaders and/or managers, they feel more powerful and valued. Empowerment is also advantageous to an organization, in respect to owering labor costs through the sharing of those managerial responsibilities with its lower-level employees. According to Dubrin (2010), leaders can promote empowerment within their organization through fostering initiatives and employee responsibility, linking work activities to the organization’s strategic goals, providing ample information to their employees, and by allowing group member or individual employees to choose their preferred method for meeting a goal (p. 205-206). One contributing factor to empowerment is the act of delegation which is more of a formal ssignment of tasks and responsibilities. Delegation, as well as, empowerment can be a very motivational tool which offers individuals the benefit of skill development. The bottom line is that both concepts represent the core principle of accountability. Teamwork is vital to an organization’s success. Being that teams consist of individuals with different backgrounds, beliefs, ideas and points of view, it is imperative that we always be respectful and embrace the rewards that diversity brings within the team. As leaders, we can foster teamwork within a group through providing team embers with clear descriptions of the team’s goals, mission and tasks, commanding performance commitment and excellence, providing direction and feedback, alleviating micromanagement practices, forming virtual teams utilizing e-leadership, and encouraging power sharing which ensures that each team member is being heard, taken seriously and treated respectfully (Dubrin, 2010). In response, Taliban tried their level best to bring Bin Laden to be trialed under Islamic law. At this, Bush made the decision to invade Afghanistan. After successfully capturing Afghanistan, the U. S captured various prisoners who he believed were associated to Al-Queda. The trouble was that many of the so called accomplices to Al-Qaeda were teenagers. Bush next target was to attack Iraq. In early 2002, Bush declared that Iraqis were developing weapons of mass destruction. He also announced that Iraqi regime was responsible for developing anthrax, nerve gas and nuclear weapons for over a decade (Andrew, 52). Based on this assumption, the United Nations sent a group of inspectors to Iraq to investigate on it. After a systematic and comprehensive search, the UN announced that were no nuclear weapons in Iraq but this was not sufficient answer for Bush. He took the decision to invade Iraq in March, 2003. There was no approval of force found with the United Nations. By doing this, Bush broke all global war agreements. His main intention to wage war on Iraq was for oil. By attacking Iraq, he is getting $5million out of Iraq per week. On attacking Iran, Bush decided to withdraw from the World Court of Law and made a decision that the policies and guidelines of United Nations were completely irrelevant. This showed that Bush’s intentions were to invade Iraq at any cost in order to get control of the oil fields.
